Terms of Sale
These Terms of Sale ("Terms") govern your purchase of wine, consulting, and related services from SHE NOSE WINES LLC ("SHE Nose Wines," "we," "us," or "our"). By submitting an allocation request, placing an order, or engaging us for consultation or travel services, you agree to these Terms.
1. Who may purchase
You must be at least 21 years of age and a legal resident of the United States to purchase wine from SHE Nose Wines. By placing an order you represent and warrant that you and the recipient of any shipment are of legal drinking age. We reserve the right to verify age and to refuse or cancel any order at our sole discretion.
2. Inquiry and allocation process
Our cellar listings are an invitation to inquire, not an offer to sell. When you submit an allocation request:
- We confirm availability, current pricing, and applicable taxes and shipping charges.
- We send you a written quote or invoice for your approval.
- An order is binding only when you have approved the quote and we have received payment in full.
- Prices, availability, and vintages are subject to change until your order is confirmed.
3. Pricing, taxes, and payment
All prices are stated in U.S. dollars and are exclusive of taxes, shipping, insurance, and any applicable excise or beverage license fees, which will be itemized on your invoice. We accept the payment methods listed on your invoice. Payment must clear before wines are released for shipment or held for pickup.
4. Title and risk of loss
Title to and risk of loss for wines purchased from SHE Nose Wines passes to you in the State of Florida at the point your order is fulfilled to the carrier or made available for pickup. Common carrier shipments are made at your request and direction; you are responsible for any loss or damage in transit beyond the limits of any optional insurance you elect to purchase.
5. Shipping and delivery
Shipping is offered only to states where it is lawful to do so and only via carriers authorized to handle alcoholic beverages. An adult signature (21+) with valid government-issued ID is required at delivery; we cannot leave wine without one. We are not responsible for delays caused by weather, the carrier, or events outside our control.
6. Returns, refunds, and damaged goods
Because of state and federal law governing the resale of alcoholic beverages, all wine sales are final and we cannot accept returns of opened or unopened wine once it has left our possession. If a bottle arrives damaged, corked, or materially not as described, contact us within seven (7) days of delivery with photographs. We will, at our discretion, replace the bottle, issue a credit toward a future purchase, or refund the purchase price.
7. Storage and pickup
If you have asked us to hold wine for you, we will store it in temperature-controlled conditions for up to thirty (30) days at no cost. After that, a modest storage fee may apply. We will notify you before any fee is assessed.
8. Consulting and travel services
Consultation, cellar planning, masterclass, and wine country travel services are billed according to a written engagement letter or proposal. Deposits paid for travel itineraries are non-refundable thirty (30) days before the start date unless we re-sell your space. We will identify any third-party deposits (lodging, transport, restaurant) that follow their own cancellation rules.
9. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, severe weather, carrier failures, regulatory changes, strikes, public-health restrictions, or supplier shortages.
10. Limitation of liability
To the fullest extent permitted by law, the total liability of SHE Nose Wines arising out of any order or service is limited to the amount you paid us for that order or service. We are not liable for indirect, consequential, or special damages.
11. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to that jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time you place your order governs that order.
